Once Adversaries in the Supreme Court Case Legalizing Gay Marriage, Now They’ve Become Friends


In 2015, the U.S. Supreme Court legalized same-sex marriage nationwide, a decision stemming from the case Obergefell v. Hodges, named after Jim Obergefell and Rick Hodges. Contrary to the case’s adversarial title, Obergefell and Hodges, who was the Ohio health director at the time, have developed a friendship since then. Their initial meeting occurred a year post-ruling, facilitated by an LGBTQ advocacy organization. Despite the difficult circumstances surrounding Obergefell’s case—stemming from the death of his partner, John Arthur, who had ALS and whose marriage was not recognized in Ohio—Hodges approached their encounter positively, acknowledging that he was “glad” to lose the case.

Obergefell and Arthur’s journey began when they flew to Maryland to marry before Arthur’s death in 2013, leading to legal action when they discovered Ohio would not honor their union on the death certificate. Although Hodges was obligated to defend Ohio’s stance, he privately supported Obergefell’s fight for recognition. In the lead-up to the Supreme Court’s decision, he worked with Ohio lawyers to create a licensing framework for same-sex marriage, anticipating a favorable ruling.

Their evolving friendship, which includes meeting two to three times a year and participating in conferences, is seen as a positive example amid social tensions. Obergefell expressed gratitude for their unique bond, suggesting that such relationships among adversaries are rare but necessary. As they acknowledge the 10th anniversary of the landmark ruling, their joint appearances highlight an inspiring narrative of understanding and collaboration in the face of societal challenges.
