Nebraska Lawmakers Propose Changes to Voter-Approved Paid Sick Leave Law

LINCOLN, NE — In a controversial move, Nebraska lawmakers have advanced a bill aimed at modifying a recently approved paid sick leave initiative set to take effect on October 1. The original law, endorsed by nearly 75% of voters last November, grants employees of businesses with fewer than 20 workers five days of paid sick leave annually, escalating to seven days for larger businesses.

However, LB 415 proposes significant changes. It would exempt certain groups—namely, young teens aged 14 and 15, temporary agricultural workers, and very small businesses with 10 or fewer employees—from providing paid sick leave. Sponsored by State Sen. Beau Ballard, the intent behind the bill is to make the voter-approved measure more workable for businesses.

The debate has seen a split between lawmakers, with many Democrats defending the original measure as a reflection of the will of the people, while Republican senators argue that the law could burden small businesses. During discussions, Sen. Mike Jacobson expressed concern that increasing costs, including paid sick leave and a rising minimum wage, could threaten employment opportunities for small businesses in his district.

Worker advocates have criticized these proposed amendments, suggesting they undermine voter intent. Anahí Salazar, policy coordinator at Voices for Children in Nebraska, voiced strong opposition, stating the changes would result in over 30,000 Nebraskans losing access to paid sick leave.

As the bill heads for a final round of debate, lawmakers remain polarized. Proponents argue modifications are essential for economic viability, while opponents warn valuing business interests over worker rights could have dire consequences for thousands of Nebraska families.
