Another family files lawsuit against New York funeral home, alleging mix-up in body sent for burial in Guatemala


A lawsuit filed against Rivera Funeral Home in New York alleges that the funeral home sent the wrong body for burial in Guatemala. The family of Elder Emilio Garcia Umul claims that the funeral home mistakenly sent the body of a 96-year-old woman instead of Garcia Umul, who was 39. The family discovered the error while watching a livestream of the funeral service in May. This is the second time that Rivera Funeral Home has been sued for a mistaken delivery since October.

The lawsuit alleges that Garcia Umul’s body was not properly prepared for transport and was carelessly left in New York. The family was horrified to learn that his body had been left in New York while they were watching the funeral service in Guatemala. The lawsuit seeks unspecified damages for negligence, emotional distress, breach of contract, and loss of sepulcher rights, which allow loved ones to have their relatives’ remains preserved and buried.

The first lawsuit against Rivera Funeral Home was filed by the family of Carmen Maldonado, whose body was mistakenly sent to Guatemala as well. Maldonado’s family was able to bring her back to Ecuador for burial. Rivera Funeral Home denied the allegations in the first lawsuit, which is still ongoing. It is unclear whether the funeral home has an attorney for the second lawsuit.
