Two Los Angeles County prosecutors, Nancy Theberge and Brock Lunsford, claimed they faced demotion and retaliation for their support of the resentencing of Erik and Lyle Menendez, who were convicted of their parents’ murders in 1989. The prosecutors alleged they were transferred out of the resentencing unit due to their advocacy for the brothers and their perceived association with former District Attorney George Gascón. The filings also claimed discriminatory treatment based on age and gender, with Theberge alleging she was undermined and transferred to a lower position. Lunsford was stripped of supervisory responsibilities and reassigned to a position with no opportunities for promotion.
The government claims, precursors to lawsuits, seek economic and non-economic damages of over $250,000 and $5 million, respectively. The prosecutors’ attorney stated they were committed public servants following the law in advocating for resentencing. The District Attorney’s Office declined to comment. The Menendez case has recently gained attention with the release of TV projects. Current District Attorney Nathan Hochman has yet to decide on reducing the brothers’ sentences, with their lawyers seeking a 50 years to life term for parole eligibility, a move endorsed by Gascón. Ultimately, a judge will decide on the resentencing.
