Remaining questions in Nebraska’s implementation of medical marijuana laws


Nebraska’s 2024 election results have been finalized, with all ballot initiatives certified on Monday. This means that the state will have a medical marijuana law, pending any successful lawsuit appeals. However, the specifics of the law, such as who will fulfill prescriptions and how the program will be rolled out, are still uncertain. The law sets deadlines for the adoption of “reasonable rules” by July 1 and the granting of applications by October 1.

The law creates a Nebraska Medical Marijuana Commission, with the initial members being the three members of the liquor control board, along with the potential addition of two more appointed by the governor. The commission will require staff, and the director of the Nebraska Liquor Control Commission has suggested that his agency may be best suited to take on this responsibility.

It remains to be seen how the legislature will proceed in implementing the medical marijuana program in Nebraska.
