The Nebraska Attorney General’s Office has filed a second “amended cross-claim” on behalf of Secretary of State Bob Evnen in a lawsuit against two successful medical cannabis measures. The brief adds allegations of circulator fraud and malfeasance to the complaint. However, Lancaster County District Judge Susan Strong ruled in favor of the ballot sponsors last Tuesday and dismissed the case. The AG’s Office has not filed an appeal to the Nebraska Supreme Court yet, but Attorney General Mike Hilgers stated they are preparing for a potential appeal.
Judge Strong questioned the credibility of a specific circulator and rejected Evnen’s theory of widespread fraud, stating that the petitions for the medical cannabis measures meet all legal requirements under Nebraska law. Evnen, along with other state officials, certified the November election results, including the cannabis measures, which are set to take effect within 10 days. The AG’s Office is ensuring their case is fully prepared for an appeal, despite the initial ruling in favor of the ballot sponsors.
