A Lancaster District Court judge in Nebraska has dismissed a challenge to invalidate two successful ballot measures that would legalize medical marijuana in the state. Despite claims made by former State Sen. John Kuehn and Secretary of State Bob Evnen against petition circulators and notaries associated with the initiatives, the judge ruled that both measures met the legal requirements to qualify for the ballot. The case is expected to be appealed to the Nebraska Supreme Court. Nebraskans for Medical Marijuana, the group behind the measures, had faced challenges in the past, with their 2020 initiative being thrown out for containing multiple subjects. However, this time, both petitions garnered enough valid signatures to qualify for the ballot, with roughly 70% support from voters for each measure. If upheld, Nebraska would join 38 other states and Washington, D.C., in legalizing medical marijuana. The initiatives propose regulating medical marijuana through a commission that will establish criteria for approving businesses to sell the drug by 2025. The campaign manager for Nebraskans for Medical Marijuana expressed gratitude for the court’s decision, emphasizing the hard work that went into the effort to provide relief for patients and families across the state.
