Former babysitter Terry McKirchy pleaded guilty to manslaughter for the 2019 death of Benjamin Dowling, who had severe disabilities after suffering brain hemorrhage as an infant. McKirchy admitted to hitting him and was sentenced to three years in prison. Benjamin’s parents are glad she admitted to hurting their son but express that nothing will bring him back. McKirchy claimed she hit Benjamin in a state of impulse and anger, causing his injuries. McKirchy had previously pleaded guilty to injuring Benjamin in 1985. McKirchy showed no emotion during the hearing where her apology letter was read. Friends and family testified about Benjamin’s impact on their lives. McKirchy had originally been charged with first-degree murder and had voluntarily entered jail in May. McKirchy had previously taken a deal in connection with Benjamin’s injuries, receiving a light sentence for attempted murder in 1985. Prosecutors could not explain why the sentence was so lenient. Benjamin’s family worked to include him in family activities despite his disabilities. Benjamin’s presence was a source of inspiration, and his family thought he would live forever. Benjamin passed away in 2019.
